AGIRÎ - The release of prisoner Selim Üldeş is being blocked on the grounds that the Administration and Observation Board is not of "good behavior", despite the decision of the Manavgat 1st High Criminal Court.
Selim Üldeş is one of the prisoners whose release was prevented due to the report of the Prison Administration and Observation Board stating that he was not "good behavior". Üldeş, who was detained and arrested in Agirî in 2013 and sentenced to 12 years in prison in the case he was tried, was supposed to be released on October 19, 2022; however, his release has been extended 3 times so far, on the grounds that he "did not call the PKK a terrorist organization" and "was in a biased cell".
THE RELEASE OF ÜLDEŞ WAS POSTPONED 3 TIMES
Üldeş, who is currently held in Manavgat No. 1 Type T Closed Prison, applied to the administration after completing his execution while he was being held in Afyonkarahisar No. 1 Type T Prison. The board claimed that Üldeş "was not on good behavior." Üldeş and his lawyer then appealed to the Afyonkarahisar Execution Judgeship. The judgeship accepted Üldeş's objection on November 8, 2022. The prison prosecutor then appealed to the Afyonkarahisar 1st High Criminal Court. On December 5 of the same year, the court accepted the objection of the prosecutor's office and decided that Üldeş would not benefit from conditional release.
After the decision, Üldeş was transferred to Manavgat Type S Closed Prison. From there, he was transferred to the prison where he is currently held, located on the same campus. The prison board here extended Üldeş's release for a second time for 6 months on the grounds that "his sincerity in leaving the organization was not confirmed." An objection was made to a higher court. Manavgat 1st High Criminal Court rejected the prosecution's objection. Despite the final court decision, Üldeş was not released on the grounds that "it is understood that the convict refrained from saying that his organization was a terrorist organization." Üldeş's application to the prison administration for the third time was rejected for the same reasons, and his release was postponed for 6 months.
LAWYER: AN UNLAWFUL DECISION
Stating that Üldeş's release was arbitrarily blocked, even though he had not received any disciplinary punishment or acted against the prison's internal regulations during his time in prison, Üldeş's lawyer, Azad Akbulut said: "Prison Administration Observation Boards carry out a separate trial within the prison. A board that has no legal basis and does not include lawyers decides whether the prisoners are of good behavior or not, with arbitrary decisions. In response to the postponement of execution and the ban on release, the Constitutional Court appealed for 'not implementing the final decision'. We have made an application. Our client's right to freedom and security is being unlawfully prevented. We are waiting for the decision of the Constitutional Court."
Akbulut said: “At this stage, it is necessary to return to the law, the situation of the prisoners should be examined by taking into account the principles of universal law, and the subjecting of prisoners with a final sentence to trial through administrative and observation boards should be abandoned. We want the final conviction and the obstruction of execution implemented through Selim Üldeş to end. We demand that our detained client be released immediately and regain his freedom."
'MY SON SHOULD BE RELEASED'
Üldeş's son, Emrullah Üldeş, condemned the situation. The son of Üldeş called: "Even though my father's sentence is over, he is not being released arbitrarily. We want my father to be released immediately and come to us. Why is he still not being released even though he has finished his sentence? We want all authorized persons to condemn this situation and bring it to the agenda."
