WAN - Ill prisoner Makbule Özer was taken to Istanbul for the ATK report on whether she can stay in prison.
82-year-old Makbule Özer, who was given a "she can stay in prison" report by the Forensic Medicine Institute (ATK) about a month ago in Wan, was sent to Istanbul for ATK to prepare a new report after the public reactions.
While Özer was arrested on the charge of "aiding a terrorist organization", her sentence was initially postponed for one year with ATK's report saying "she cannot stay in prison".Then, Özer was sent to prison again with ATK's report stating that she could stay in prison. After approximately a month of imprisonment, Özer was referred to the Istanbul Forensic Medicine Institute (ATK) yesterday for a new report.
WHAT HAPPENED?
The house of Makbule Özer and Hadi Özer (80), who live in Artemêt (Edremit) district of Wan, was raided on July 24, 2018, on the grounds that they were "members of a terrorist organization". All family members were detained during the raid. Later, a lawsuit was filed against Makbule Özer and Hadi Özer on the charge of "knowingly aiding a terrorist organization". As a result of the case, the Özer family was sentenced to 2 years and 6 months in prison.
HER JUDGMENT WAS DEFERRED
After the sentence was approved by the Supreme Court of Appeals, the Özer couple were arrested on May 9, 2022 and sent to Van High Security Prison. Makbule Özer, who has many diseases and is 61 percent disabled, had her sentence postponed for one year upon ATK's report that she "cannot stay in prison". Özer was released on September 7, 2022, and her husband Hadi Özer was released after completing her sentence.
ATK TRANSLATOR WAS A 'SECURITY GUARD'
Following the expiry of the one-year postponement period of the sentence execution, ATK gave a report that "she can stay in prison" this time, and the Van Chief Public Prosecutor's Office requested a new report to resolve the contradiction between ATK's first and second reports. Thereupon, on April 3, 2024, ATK once again reported that she can stay in prison, and Özer was sent to Van Type T Closed Prison again on April 22.
In the report given by ATK, it was revealed that the person who was translating Kurdish was a "security guard" since Özer did not know Turkish.
