ANKARA - HDP applied to the Constitutional Court (AYM) for the nullification of the decision to strip Ömer Faruk Gergerlioğlu of his status as an MP.
Peoples' Democratic Party (HDP) applied to the Constitutional Court (AYM) or the nullification of the decision to strip Ömer Faruk Gergerlioğlu of his status as a member of the parliament. Gergerlioğlu made a statement in Ahlatlıbel Park opposite the AYM with the participation of HDP Istanbul Deputy Erol Katırcıoğlu and lawyers.
'THIS IS A THEATER PLAY'
Gergerlioğlu stated this was a theater play and said: "My status as a member of parliament was stripped of even though I did not commit any crimes. Everyone knows that this is not right. But some people still remain silent. This is a murder of justice which one day might happen to you. Don't remain silent. They will do it to me today, and they will do it to you tomorrow. The accusation against me is a tweet. No one can say tweeting something is a crime. You don't need to be a lawyer to understand that this is not legal."
CALL TO ŞENTOP TO RESIGN
Underlining that he still had immunity at the time when his sentence was finalized, Gergerlioğlu said: "This decision is a matter of unlawfullness. Dozens of Constitutional lawyers wrote about it. They objected and rejected the decision. How can they not? This is a decision that disregards the constitution. But Mustafa Şentop read this decision not caring about it being unlawful. Shame on him for not protecting the will of the people. I invite him to resign."
FAKE VIDEO IN OFFICIAL DOCUMENT
Gergerlioğlu said: "Even though he knew it was all slander and lies, Şentop added a fake video to the official document. Who can we trust? I was detained as a result of a fake video and Mustafa Şentop did that."
MPS MUST CHOSE THEIR SIDE NOW
Addressing the members of the parliament from other parties, Gergerlioğlu said: "My party stands with me at all times. But MPs from other parties must chose their side now. Will they stand with me, who has been wronged or will they stand with Mustafa Şentop who did this unlawfulness act. I am expecting their open and clear support. The Speaker of the Assembly has an obligation to protect the Constitution and the immunities of the members of the parliament. How can you dismiss an MP who has been the deputy of 83 million people? The will of the people is trampled with this decision. I will be locked behind bars."
AYM MUST PUT AN END TO IT
Stating that the Constitutional Court only rejected the cautionary decision they made, Gergerlioğlu said: "What is AYM waiting for? For an MP to be sent to prison? We will submit one more appeal today. And we expect a fair decision. Who am I to trust? Who will I trust if AYM does not provide justice? The politicians may have taken over the judiciary, but AYM can put an end to it. There is a court that provided justice for Enis Berberoğlu and I am expecting the same. I worked day and night for the peoples of Turkey. They are doing this to me because I exposed the violations of rights.
Expressing that they expect a fair decision from the Constitutional Court for their application, Gergerlioğlu said: "I expect the AYM to do what's right and put an end to it."
