Missing for 52 days, decision of non-prosecution for Mehmet Bal’s case! 2020-03-15 10:24:22 İSTANBUL- In the investigation started to find the whereabouts of Mehmet Bal, who has been missing for 52 days after coming to İstanbul from Batman to visit his son in prison, it was decided that "there is lack of grounds for legal action". Nothing has been heard from Mehmet Bal for 52 days, who came to İstanbul on January 24 to visit his son in prison and met with his relatives in Bağcılar after visiting his son on the same day. All the efforts of the police and his family, who applied to the Bakırköy Chief Public Prosecutor's Office, failed.   'LACK OF GROUNDS'   The Chief Public Prosecutor's Office decided to the non-prosecution of the investigation of Bal. Bal's family indicated that the investigation never carried out effectively. As for the decision, the following reasons took place:   “It has been reported that there is no evidence or indication that he has been kidnapped, forcibly detained or killed, that the necessary notification has been made to the Criminal Recort Database Office for the to carry out the the necessary actions related to the missing case and that the search and investigation procedures related to the missing person have been continued, it is understood from the scope of the file that the person in question is of majority age and that there is no alleged crime or offender related to the person at this stage and that he did not make a claim and evidence that the disappeared person was kidnapped or that he was the victim of another crime and that there is lack of grounds for legal action so that the decision of non-prosecution should be forwarded to the family..."   'THE FILE IS CLOSED BASED ON ASSUMPTIONS'   Stating that the prosecution's decision was wrong, the lawyer of the Bal Family, Ahmet Baran Çelik, said that there are many lacks and incompleted points in the investigation file.   Saying that the file was immediately closed without taking the images that the police shared with the family into consideration, Lawyer Çelik indicated that the investigation file, regarding which a decision of non-prosecution was given finally, carried out without careful research and examination and the decision of non-prosecution was given based on an assumption that Bal was an adult and probably he lost contact with his family by his will.   'MY FATHER IS IN THE HANDS OF THE STATE'   Mehmet Bal's son, Ercan Bal, stated that they are worried about his father's life, as the state institutions did not give enough effort to find him. Stating that he told the prosecutor that other losses were found quickly, Bal shared that the prosecutor reply as: 'Those losses are different from this loss'.   Saying that this caused question marks in their minds, Bal said: “What does it mean to be different from the others? State officials must shall this. With his speech, I understand that my father is in the hands of the state. If my father is in the hands of the state, why is he kept in the hands of the state? They have to give us information. Likewise, from the police station; It was said 'don't come here'. They also told us, 'If you come here, we will get you out'. How and with what right, do they say this to someon,  whose father is missing and who applies to the authorities of the state to find him? After that, they showed us images of my father getting on the ferry, but there were no images of him getting out of the ferry. Doesn't my dad ever get off the ferry? Is there no camera inside the ferry? We understand from here that the state does not fulfill its duty."   Emphasizing that this is why he definitely thinks his father is in the hands of the state Bal said, "I want my father from the state. They are the responsibles of this."
