Diyarbakır Bar Association President Aydın: Unlawfulness continues if the TMK definition remains unchanged 2019-09-04 12:51:51 DIYARBAKIR - Diyarbakir Bar Association President Cihan Aydin, who stated that the Judicial Reform Strategy Document brought to the agenda by the government should be negotiated by large groups, said: “For example, if you do not rewrite the definition of TMK, you cannot avoid the unlawfulness."      52 Bar Association reacted to the New Judicial Year Ceremony held at the Presidential Complex and did not participate in the event and refused the invitation of the Supreme Court.  Diyarbakir Bar Association President Cihan Aydin stated that to respond to the invitation to the palace at a time where the impartiality and independence of the judiciary is at question would not be correct.     Reminding that there is no information about the content of the New Judicial Reform Strategy Document and that the public is informed only within a framework, Aydın said: "The main framework was shared with the public and sent to us but in the end it points to a framework. For example, if you do not correctly define the definition of terrorism in the Anti-Terror Law (TMK), if you do not correct it, you cannot avoid the unlawfulnesses. The issue of media freedom is the same,so is the freedom of speech. If you punish every single person that use their right to  protest, the unlawfulness continues. So this is what makes us feel a bit desperate. "   Aydın stating that the document needs to be discussed with the bars, NGO's, rights organizations, said: "It has to include the expectations of the society. That's how this document becomes important. I hope the freedom of speech, the definition of terror, the right to assembly and demonstration will be re-arrenge into a more inclusive and liberated form."
