Families of those who lost their lives in the military raid sued 2023-12-20 11:53:08   AGIRÎ - The families of HPG members and Murat Kaya, who lost their lives in an operation carried out in 2019 in the Mûşîyan village of Dûtax district, were put on trial due to the fine imposed on them for "damage to public property and personnel".   In the operation launched by many soldiers, police and rangers in Mûşiyan village of Agirî's Dûtax (Tutak) district on December 6, 2019, 3 HPG members and father of 3 children, Murat Kaya, lost their lives. After the conflict, 10 citizens were detained under torture. Hanım Aksoy, Alican Aksoy, Kemal Aksoy, Ahmet Aksoy, Cemal Aksoy, Fikret Çetin, Zozan Kaya, Birgül Çetin and Mehmet Sıddık Çetin, who were detained under torture, were sent to the courthouse on December 12 after being detained for 7 days. Cemal Aksoy and Fikret Çetin were arrested on the grounds of "being  members of a terrorist organization".   THE COURT GAVE THE PENALTY   After the indictment against the 6 people taken into custody was accepted, the trial began at the Ağrı 2nd High Criminal Court. An acquittal decision was given for Ahmet Aksoy and Mehmet Sıddık Çetin. Birgül Çetin, 3 years, 1 month and 15 days; Ms. Aksoy was sentenced to 6 years and 3 months on the allegation of "being a member in a terrorist organization".   Prisoner Cemal Aksoy was sentenced to 12 years in prison and Fikret Çetin was sentenced to 7 years and 6 months in prison for "being a member of a terrorist organization". Erzurum Regional Court also approved the decision of the local court. The file is currently at the Supreme Court.   ENFORCEMENT TO FAMILIES FOR 'DAMAGE TO PUBLIC PROPERTY'   After the file was sent to the Supreme Court, the Gendarmerie General Command filed a compensation lawsuit against the families of the HPG members who lost their lives, the heirs of Murat Kaya and the still detained Cemal Aksoy, on the grounds that they caused "damage to public property and personnel". The court decided to impose a fine of 7 thousand 817 TL each. Upon non-payment of money, enforcement proceedings were initiated against the families by Erzurum 5th Enforcement Office. The families appealed against the decision.
