Lawyer Demir: İmralı is the black hole of law 2023-09-27 10:58:46   WAN - Lawyer, who described İmralı Prison, where he met with PKK Leader Abdullah Öcalan 7 times, as "the black hole of the law". Cemal Demir emphasized that diplomacy and intensive legal application mechanisms should be implemented against isolation.   PKK Leader Abdullah Öcalan, who was the target of the destruction and liquidation plans of global powers, was brought to Turkey on February 15, 1999, with the international conspiracy that started with his departure from Syria on October 9, 1998. Abdullah Öcalan, who could not be destroyed by the international conspiracy coordinated by the United States of America (USA) to implement the Greater Middle East Project (BOP), was brought to Turkey after Europe, where he was crucified by his own definition. Abdullah Öcalan, who was brought to the specially designed Imrali Type F High Security Prison during the 130-day "battue" process in Europe, has been held in severe isolation conditions for 25 years, and has not been heard from in any way for the last 30 months.   Stating that he was welcomed by an official from the European Committee for the Prevention of Torture (CPT) in İmralı, where he was brought with an international conspiracy, Abdullah Öcalan likened the conspiracy to a theater and said: "Someone else wrote the script, it was played in İmralı" and drawing attention the role of international forces in the conspiracy and the Imrali isolation system. PKK Leader stated that İmralı is a CPT project and underlined that the isolation system should be abolished and the principles should be implemented.   CPT, which welcomed Abdullah Öcalan, visited İmralı only 11 times in 25 years. As the state of not receiving any news from Imrali entered its 30th month, the CPT, which visited Imrali on September 20-29, 2022, deepened public concerns with its contradictory statements.   Lawyer Cemal Demir, who went to İmralı Island 7 times between 2008 and 2011 and met with the PKK Leader, evaluated the process leading to October 9, 1998, which Abdullah Öcalan defined as the Conspiracy of the 21st Century, and came to Turkey after 130 days of "battue". He talked about İmralı Prison and drew attention to the role of the forces involved in the conspiracy in the isolation system.   HISTORICAL LAW SCANDAL   Stating that Abdullah Öcalan was subjected to pirate law, Demir said: "The PKK Leader could not benefit from any international legal protection rights when he left Syria and went to Europe, and that his applications for political asylum were ignored by destroying all European law. Even the decision of the Court of Appeal in Rome, where the second nail of the cross against Abdullah Öcalan was hammered, was not valued. By issuing an arrest warrant with the Interpol red notice and abusing this institution, the European system and law have created a historical scandal."   THE BLACK HOLE OF THE LAW: İMRALI   Stating that the same approach was continued in Turkey this time with the February 15 process, Demir said: “Under extraordinary circumstances and in violation of all the basic principles of Turkish law, especially the principle of the natural judge, the case was concluded with a show trial in a few months. The Supreme Court process of the case did not last long. The European Court of Human Rights (ECHR), where the trial was carried, did not act in accordance with its historical role and judicial experience, and made a reductive violation decision only in the context of the military member. Thus, once again, the Kurdish people's quest for justice was not met on the grounds of world law. For this reason, the international conspiracy and the Imrali system have been very aptly defined as the 'black hole of law'."   INTERSTATE INTERESTS   Drawing attention that interstate interests are also an important factor in the NATO-Gladio conspiracy, Demir said: "Regional conflicts and interests such as the 'Blue Stream Project' of the Turkish state with Russia and the 'Aegean Islands and Cyprus Issue' with Greece are also decisive in this conspiracy.  As Mr. Abdullah Öcalan stated, it is indisputable that the October 9 conspiracy is a link in this war escalated by the NATO sector against the people's demands for freedom, equality and democracy. Likewise, hegemonic powers such as Germany, England and the USA have been important supporters of this process. The aim was to deepen the war and stifle the democratic solution to the problem. The interests and projects of the hegemonic powers of the period were in this direction. But with the Imrali resistance, the conspiracy was foiled and these plans and projects were prevented from coming to life."   DEFINITION OF EXECUTION LAW: ISOLATION   Stating that isolation and isolation gained concreteness in the person of Abdullah Öcalan, Demir said: “The concepts of isolation and isolation gained concreteness, especially in the person of Mr. Abdullah Öcalan, and has now become another definition of Turkish execution law. The aim of this method is to sever the ties of political figures held hostage with their families, lawyers, society and political movement. There have been many discussions about the Imrali isolation. However, the lack of any serious action or activity aimed at lifting this isolation has unfortunately made the isolation permanent and systematic. Every prisoner has the most basic, minimum and indispensable human rights. Such as legal support from a lawyer, family visits, telephone and letter rights in the context of communication, and some other social and communication rights within the prison. Since the day Öcalan was put in the island prison, none of his rights have been exercised properly and regularly. Each time, excuses were made for bad weather, coaster malfunction, or disciplinary punishment. Most of the time, no excuses were needed. As it is known, after July 2011, regular lawyer meetings were abolished and an operation was carried out on their lawyers."   ARBITRARY IMPLEMENTATION IN IMRALI   Stating that Imrali was specially designed and that arbitrariness, not legislation, became the management style, Demir continued his words as follows: “The CPT, which is affiliated with the Council of Europe, of which the Turkish state is a member, does not fulfill its mission at this point. In order to evaluate the treatment of people deprived of their freedom, this committee can visit prisons, among other places, without any control or restriction, and hold private meetings with prisoners. It has visited many prisons so far. It also went to İmralı Island Prison several times. However, there has been no satisfactory explanation to date, especially about the Kurdish Leadership in Imrali Island Prison. Thus, the CPT exhibited the legal practice of the member state, not the law and values to which it adheres. This practice calls into question the legitimacy of the institution.”   ISOLATION IS A WAY OF THE KURDISH ISSUE   Stating that isolation is a way of approaching the Kurdish people and the Kurdish issue, Demir said: “It isolates the voice of a peaceful and democratic solution to the Kurdish issue. It leaves you breathless and out of breath. The fact that the Turkish state is security-oriented and closed to democracy is another result of its approach to the Kurdish issue because it has turned the Kurdish issue into a survival issue. It is at war with the Kurds in three parts. Apart from its own military force, it also supports militarily and economically the army of paramilitary gangs numbering hundreds of thousands against the Kurds. All economic resources of the country are transferred to the war.
