Journalist Güleş sentenced to 1 year and 9 months 2023-04-18 15:59:01   DİYARBAKIR- Journalist Mehmet Güleş, who was tried again after the Supreme Court reversed the sentence given to him for "propagandizing for a terrorist organization", was sentenced to 1 year, 9 months and 25 days.   The second hearing of the retrial, which started with the reversal of the prison sentence of 3 years, 1 month and 15 days, which was given to journalist Mehmet Güleş for "making propaganda for a terrorist organization" for his news posts on social media, has been held.   After the Supreme Court of Appeals filed an appeal against the crime of "propagandizing for a terrorist organization", the decision of the Elazığ 2nd High Criminal Court and approved by the Antep Regional Court of Justice was overturned due to the "disproportionate punishment" given by the 3rd Penal Chamber of the Court of Cassation. The second hearing of the case, which was reopened at the Elazig 2nd Heavy Penal Court and the first of which was postponed due to the earthquake, was held. Güleş and his lawyer, Resul Temur, were connected via the Diyarbakır Courthouse Audio and Video Information System.   THE PROSECUTOR WANTS PRISON SENTENCE   Presenting its opinion to the court at the hearing, the prosecution demanded that journalist Güleş be punished for "making propaganda for a terrorist organization".   'FREEDOM OF THOUGHT AND EXPRESSION'   Defending against the opinion, Güleş stated that his posts were news content belonging to the Dicle News Agency, where he worked at that time, and stated that this was a journalistic activity. Expressing that the demand for punishment was ignoring the freedom of thought and expression, Güleş demanded his acquittal.   PRISON SENTENCE   Considering that the previous sentence of 3 years, 1 month and 15 days was overturned by the Supreme Court due to disproportion, the court sentenced Güleş to 1 year 9 months and 25 days in prison.
